Section 01

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and William Kim ("we," "us," or "our"), the operator of MONARCH: Hunter Protocol (the "App"). By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree with any part of these Terms, you must immediately discontinue use of the App. Your continued use of the App following any updates to these Terms constitutes your acceptance of the revised Terms.

Section 02

2. Eligibility

By using the App you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into a binding agreement;
• You are not prohibited from using the App under applicable law; and
• All information you provide during registration is accurate and truthful.

We do not knowingly collect information from or direct the App toward individuals under 18 years of age. If we become aware that a user is under 18, we will terminate that account without prior notice.

Section 03

3. User Accounts

To access the core features of MONARCH: Hunter Protocol, you must register for an account using a supported sign-in method (Sign in with Apple or Sign in with Google). You agree to:

• Provide accurate, current, and complete information during registration;
• Maintain the security and confidentiality of your account credentials;
• Promptly notify us of any unauthorized access or suspected security breach;
• Accept full responsibility for all activity that occurs under your account.

You may not share your account with another person, create multiple accounts for the purpose of gaining an unfair advantage, or impersonate any other user.

Account Deletion. You may delete your account at any time by navigating to Settings > Delete Account within the App. Deletion is permanent and irreversible — all your data, progression, stats, and workout history will be permanently removed from our systems with no possibility of recovery.

4. Acceptable Use

You agree to use the App only for its intended purpose of personal fitness tracking and progression. The following activities are strictly prohibited:

• No misuse or abuse: Using the App in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other user's enjoyment of the App.
• No reverse engineering: Attempting to decompile, disassemble, reverse engineer, or otherwise derive the source code, algorithms, or trade secrets of the App.
• No false data: Submitting fabricated, artificially inflated, or otherwise dishonest workout data for the purpose of gaming the XP, ranking, or leaderboard systems.
• No unauthorized access: Attempting to gain unauthorized access to any portion of the App, other user accounts, or related systems.
• No automated scraping: Using bots, scrapers, or other automated tools to extract data from the App without our express written consent.
• No violation of law: Using the App for any purpose that is unlawful or prohibited by these Terms.

We reserve the right to investigate suspected violations and to take appropriate action, including account suspension or termination and referral to law enforcement where warranted.

Section 05

5. Health Disclaimer

Before beginning any new exercise program or significantly increasing your training intensity, you should consult a qualified physician or licensed healthcare provider, particularly if you:

• Have a pre-existing medical condition or injury;
• Are pregnant, postpartum, or have recently undergone surgery;
• Experience chest pain, shortness of breath, or dizziness during exercise;
• Have been previously advised by a doctor to restrict physical activity; or
• Are taking medications that may be affected by exercise.

The XP values, stat gains, rank milestones, and training recommendations within the App are game-mechanic constructs designed for motivation. They do not reflect clinical exercise prescriptions and should not be interpreted as such. You assume full responsibility for your physical wellbeing and any injuries, health complications, or adverse outcomes that may result from your use of the App.

Section 06

6. Intellectual Property

The App and all of its contents — including but not limited to its name, logo, design, graphics, user interface, source code, copy, game mechanics, rank system, XP engine, hunter progression framework, and all other creative or technical elements — are the exclusive intellectual property of William Kim / MONARCH: Hunter Protocol and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws.

These Terms do not grant you any ownership rights in the App. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for your own personal, non-commercial fitness tracking purposes. You may not:

• Copy, reproduce, or distribute any part of the App without prior written permission;
• Create derivative works based on the App's content or design;
• Use the App's name, logo, or branding in any way that implies endorsement or affiliation;
• Remove or alter any proprietary notices or labels on the App.

Your workout data and personal fitness logs remain your own. We claim no ownership over the personal data you input into the App.

Section 07

7. Third-Party Services

MONARCH: Hunter Protocol integrates with and relies upon the following third-party services to deliver its functionality. By using the App you acknowledge that you are also subject to the terms of service and privacy policies of these providers:

• Apple — Sign in with Apple authentication and iOS platform services. Subject to the Apple Media Services Terms and Conditions.
• Google — Sign in with Google authentication and Google Play services. Subject to the Google Terms of Service.
• Supabase — Backend database, authentication infrastructure, and cloud storage. Subject to the Supabase Terms of Service.
• Sentry — Crash reporting and application performance monitoring. Subject to the Sentry Terms of Service.
• Anthropic — AI services. Subject to the Anthropic Consumer Terms of Service.

We are not responsible for the content, policies, or practices of any third-party service and do not make any representations or warranties regarding them. Any interactions you have with these services are governed solely by their respective terms.

Section 08

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranty that the App will be uninterrupted, error-free, or free of viruses or other harmful components;
• Any warranty regarding the accuracy, completeness, or reliability of any content within the App;
• Any warranty that defects in the App will be corrected.

We do not guarantee continuous availability of the App and reserve the right to modify, suspend, or discontinue the App (or any portion thereof) at any time, with or without notice, and without liability to you.

Section 09

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WILLIAM KIM AND MONARCH: HUNTER PROTOCOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including without limitation:

• Physical injury, bodily harm, or health complications resulting from exercise undertaken in connection with use of the App;
• Loss of data, workout history, progression, or account information;
• Loss of profits, revenue, or business opportunities;
• Unauthorized access to or alteration of your data;
• Conduct of any third party using the App.

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability is limited to the greatest extent permitted by law.

In no event shall our total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the App exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) $100 USD.

Section 10

10. Termination

We reserve the right to suspend, restrict, or permanently terminate your account and access to the App at our sole discretion, without prior notice or liability, if we reasonably believe you have:

• Violated any provision of these Terms;
• Submitted fraudulent or materially false workout data;
• Engaged in conduct harmful to other users or to the integrity of the App;
• Attempted to circumvent security measures or exploit the App;
• Violated any applicable law or regulation.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — shall survive.

You may terminate your own account at any time through Settings > Delete Account.

Section 11

11. Governing Law

These Terms and any dispute arising out of or relating to them or the App shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict-of-law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Illinois, and you hereby consent to personal jurisdiction and venue in such courts.

Section 12

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we may also provide in-app notification.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the App and may delete your account via Settings > Delete Account.

We encourage you to review these Terms periodically to stay informed of any updates.
